There are many laws regulating online gambling. However, many of these are based on the state level. The federal government has taken action against illegal Internet gambling in various forms.
One of the most prominent and well-known online types of gambling is online poker. Players can participate in tournaments or play actual cash games. Some sites allow both types of gaming, while others offer only one.
Interestingly, this type of gambling is legal in a handful of nations in the Caribbean. A number of countries in the European Union also have legalized it.
On the other hand, some states in the United States have banned or restricted it. In some cases, a person’s liberty is in jeopardy if they engage in such gambling.
Some states have adopted the Public Gambling Act, 1867. Other states have created their own gambling laws.
The United States’s Unlawful Internet Gambling Enforcement Act (UIGEA) was originally introduced as a bill in the US Senate in 1999. It would have prohibited American citizens from participating in online gambling.
The statute has been challenged in court on both constitutional and statutory grounds. While attacks based on the First Amendment’s guarantee of free speech have been successful, arguments based on the Commerce Clause and the Due Process Clause have not.
